national et europ\u00e9en, la Cour de cassation a d\u00e9cid\u00e9 d\u2019amorcer un changement qui \u00e9tait pr\u00e9visible. En effet, ce mercredi 13 septembre 2023, par diff\u00e9rents arr\u00eats dits \u201cde principe\u201d, la Cour de Cassation (plus haute juridiction de notre ordre judiciaire) a op\u00e9r\u00e9 un revirement de jurisprudence.<\/p><p>Jusqu\u2019\u00e0 aujourd\u2019hui, et ce conform\u00e9ment aux dispositions du Code de Travail, les juges consid\u00e9raient qu\u2019un salari\u00e9 qui justifiait d\u2019un arr\u00eat maladie de droit commun d\u00e9passant quatre semaines, perdait son droit d\u2019acquisition aux cong\u00e9s pay\u00e9s pour les p\u00e9riodes d\u2019absence \u00e0 venir (relatives \u00e0 cet arr\u00eat).
